Design briefing and quoting
You have been provided a quote in response to your communicated graphic design requirements. If a service has not been clearly listed in this quote, it is not included in the cost. Alterations to your brief (scope of work) will incur further costs, and we reserve the right to alter this quote if we believe the alterations fall outside of the work originally quoted. Any additional work, revisions or variations outside of the original brief will be charged at the rate of $80 per hour, billed in 15 minute increments. All prices exclude GST. Additional expenses will be charged accordingly.
It is your responsibility as the client to contact me before approving the quote if you have queries or require clarification about any items included in the quote. It is also your responsibility as the client to ensure this estimate accurately reflects the scope of work you require. If a delivery date for final artwork is not decided upon and noted during the initial consultation, payment will be required at the time of delivery of final artwork.
Before undertaking your work, you must sign approval of the quote and, if your organisation uses an ordering system, provide an order number or purchase order. Your acceptance of this quote includes full acceptance of the conditions and payment terms listed in this document. Once quotation approval has been provided, these conditions and payment terms are not negotiable.
I will not schedule or begin work on your project until we receive from you all of the artwork, content and other files required for the project, as well as the signed estimate.
Usually, projects are produced according to a brief developed in consultation between you and me. If you have not supplied a written brief, I may ask you to fill out our briefing form before I create a quote. You need to check the quote and make sure it reflects the scope of the work. If you have a query, we will not proceed with the work until your concern has been addressed.
Checking and approval
As the client, you are responsible for checking your project for any errors, including spelling, grammar, quality of images and illustrations. Your are also responsible for approving the final project so you may request another proof if changes are required. When you advise us that you approve a project, I take this to mean that you have checked it thoroughly for errors and that you are satisfied it has been completed to your satisfaction. Although I have procedures in place to ensure the highest quality of work, checking for errors and any costs of repairing errors are your responsibility.
As much as possible, I accommodate amendments to your work within my quotes. However feedback, corrections and alterations to the brief over and above those quoted will be charged as outlined in your estimate. The usual process for artwork production includes: you supply content to be included in the artwork, I then supply a first draft, following that you email detailed changes, and I then include those changes in a follow up pdf proof to you. Subsequent rounds of changes may follow. You will be advised by email when time exceeds the quoted amount, following that additional costs will be charged.
Deadlines
I am used to meeting tight deadlines and I have a strong reputation for fast, reliable work. However, if you significantly alter the brief or other circumstances occur beyond my control, I may advise you of revised timelines. My regular turnaround time for artwork production and considerable amendments is between 3-5 days, however this is dependent on the size of your project.
Payment terms and pre-payments
My invoices are to be paid within 7 days of the invoice date, any other arrangement needs to be discussed prior to quotation approval. If you’re a new client, we reserve the right to invoice you 30 per cent of the total project fee before beginning work. If payment is delayed longer than 30 days, I reserve the right to withhold future and existing work until payment is made.
If you have ordered my work on behalf of a third party, my payment terms still apply. Payment is required when my work is complete, not when you receive payment. If you do not pay me by the due date on an invoice, I reserve the right to stop production on any of your projects. Payback schemes or loan arrangements are not offered.
Limitation of liability
By commissioning our services, you are agreeing that you will not hold me liable for any incidental or consequential damages which arise from my failure to perform any aspect of the project in a timely manner, regardless of whether such failure was caused by intentional or negligent acts or omissions of me or a third party. Furthermore, I disclaim all implied warranties.
Photography, images and text content
Unless otherwise specified in this estimate, I will charge you an additional amount if I purchase images from a stock library for your project. Please note that you are responsible for ensuring all of your supplied images match the specifications I give you for your project. I expect you to comply with all relevant copyright and privacy laws. I reserve the right to charge additional time to assess your photo files and improve substandard images. Please supply all text, graphics and photography in a digital format.
Print management and file output
I do not offer print management. I include a file output fee to cover the cost of supplying the file.
Project management
All projects require project management. This fee covers the non-creative or strategic hours I expect will be expended in delivering your project.
Your obligation
You have sole responsibility of ensuring the suitability and availability of any trademark rights, copyrights or other property rights that are intended to vest in the works that I have been commissioned to produce in accordance with your instructions.
Copyright
Ownership of copyright over all concepts and draft artwork remains with me. This includes, but is not limited to; logos, symbols, compositions and copy. Unlawful use of these artworks by the client is strictly prohibited. The use of Artwork prior to payment is illegal. For more information visit http://www.copyright.org.au/information
Artwork designed will remain my property until the account is paid in full. Upon full payment of account, copyright ownership will be transferred to you. I retain rights to utilise artwork and all design elements for self promotion unless otherwise specified.
Web Site Design
You agree to allow me to add a small credit on the customer's website. This will be in the form of a small line of text placed towards the bottom of the page, unless otherwise agreed. You agree to allow me to place website and other designs, along with a link to the your site on my own website for self-promotional purposes, unless otherwise agreed.
Web Site Design Post-Completion Alterations
Upon completion of website build, I will provide you with opportunity to review the resulting work. Any additional work, revisions or variations outside of the original brief will be charged at the rate of $80 per hour. I will not activate the website until approval is received by you.
SEO Search Engine Optimisation and Search Engine Listings
I choose to use the Squarespace platform to build website. I build websites according to the trends of SEO at the time of building and SEO management is built into the Squarespace platform. SEO key phrase choice is your responsibility.
I cannot guarantee presence of Google or search engine listing, the position of website in any search engines, which or if any of the web pages will be listed in any search engines, the time it will take for any search engines to list the web site and effectiveness of key words/key phrases.
Technological advancements
You are to refer to your hosting and domain name providers for queries regarding the following services: domain names, hosting and registration, SSL certificates, email addresses and email hosting. You should refer to your own technical support company for queries regarding the following services and their applicable terms and conditions: set up of email addresses, emails going to spam/junk, email not functioning and email signatures. I hold no responsibility if your email addresses are targeted with spam as it is outside of our control. I hold no responsibility if the your email account details are attained and used to send spam or malicious material.
I do not provide the following services: domain names, hosting and registration, SSL certificates, email addresses, email hosting, setup of email addresses, emails errors of any kind and email signatures.
I build and design websites to the best of my knowledge at the time of completion. I cannot take responsibility if your site is "hacked". I do not provide software updates or take responsibility if the software used becomes out of date and obsolete. I do not take responsibility for any unforeseen advancements in technology that may have negative effects on any aspects of your site or system.
